6.3在履行合同过程中,经办人员若发现并有确切证据证明对方当事人有下列情况之一的,应立即中止履行,并及时书面上报公司办公室处理,并报总经理。
6.3.1经营状况严重恶化;6.3.2转移财产,抽逃资金,以逃避债务;6.3.3丧失商业信誉;6.3.4有丧失或者可能丧失履行债务能力的其他情形;6.4债权债务的定期确认和发生重大变动时的确认;6.4.1在常年合同特别是常年销售、采购合同履行过程中,经办人员应定期对帐,确认双方债权债务;6.4.2在对方当事人发生兼(合)并、分立、改制或其他重大事项以及本公司或对方当事人的合同经办人员发生变动时,应及时对帐,确认合同效力及双方债权债务。
7.经济合同纠纷的调解、仲裁和诉讼7.1合同双方在履行过程中发生纠纷时,应首先按照实事求是的原则,平等协商解决;7.2合同双方在一定期限(一般为一个月)内无法就纠纷的处理达成一致意思或对方当事人无意协商解决的,经办人员应及时书面报告部门经理和总经理,并拟定处理意见,报总经理决定。
对方当事人涉嫌合同诈骗的,应立即报告公司办公室和总经理。
7.3公司决定采用诉讼或仲裁处理的合同纠纷,以及对方当事人起诉的,相关部门应及时将合同的签订、履行、纠纷的产生及协商情况整理成书面材料连同有关证据报公司办...
