荆楚网消息(楚天都市报)(记者陈俊)日前，国务院办公厅下发《关于进一步严格征地拆迁管理工作切实维护群众合法权益的紧急通知》后，记者昨日从有关部门了解到，湖北省去年底已公布最新的征地补偿标准。
去年10月4日下发的湖北省人民政府关于公布湖北省征地统一年产值标准和区片综合地价的通知(鄂政发〔2009〕46号，简称46号文)，即为我省最新的征地补偿标准。省国土厅征地管理处相关人员介绍，省内各市、县因区域发展有差异性，各地补偿标准不一，省人民政府将根据经济社会发展情况，适时对新征地补偿标准进行修订，但目前新的标准刚开始执行，两三年内不会调整。
根据46号文，武汉、襄樊、荆州、黄石四地的主城区实施征地区片综合地价。最高的为武汉市I区，30万元/亩，范围在江岸区后湖、花桥、红桥等地，最低的在黄石IV区，3.718万元/亩。在征地统一年产值标准中，宜昌城区I区的征地补偿标准最高，为4.9497
亩，区域为西陵区窑湾乡、峡口风景区、伍家岗区伍家乡、宜昌经济技术开发区。最万元/
低的是长阳IV区，1.62万元/亩。

荆州市中心城区征地补偿安置暂行规定
第一条 为规范土地征收秩序,统一我市中心城区征地补偿标准,维护被征地农民合法权益,保障我市经济发展用地需求,根据《中华人民共和国土地管理法》和《省人民政府关于公布湖北省征地统一年产值标准和区片综合地价的通知》(鄂政发〔2009〕46号)及其他有关规定,结合我市实际,制定本规定。
第二条 市中心城区规划范围内,集体土地的征收、补偿和安置,适用本规定。
第三条 市中心城区土地征收工作实行属地管理。市人民政府负责市中心城区土地征收的统一管理,制定土地征收政策;确定土地征收计划;协调重大项目的征地事项。
各区人民政府、荆州开发区管委会负责本辖区内土地征收的组织和实施工作,制定和落实土地征收方案,负责被征地农民的补偿、安置工作,协调处理土地征收中的矛盾和问题。
市国土资源局负责土地征收的指导、检查,拟定土地征收计划,审查、上报土地征收方案;区(开发区)国土资源部门具体承担土地征收工作。
第四条 征收土地实行综合补偿。综合征地补偿费用为法定征地补偿费(土地补偿费、安置补助费)和农民参加社保政府出资部分。被征土地上的青苗、地上(含地下)附着物,依照有关规定予以补偿。
第五条 市中心城区内征地补偿遵循政府主导、统筹兼顾的原则。综合征地补偿费用以省人民政府《关于公布湖北省统一年产值标准和区片综合地价的通知》(鄂政发〔2009〕46号)文件为依据,兼顾政府、农村集体经济组织、农民个人以及用地单位等各方利益,解决被征地农民社会保障问题,合理确定综合征地补偿费用。
国家法律、法规和政策对征地补偿标准另有规定的除外。

4.8万元/亩,其中法定征地补偿标准为3.086万元/亩,三级区域最高不超过3.9万元/亩,其中法定征地补偿标准为2.942万元/亩,四级区域最高不超过3.4万元/亩,其中法定征地补偿标准为2.8万元/亩。法定征地补偿标准按照省人民政府(鄂政发〔2009〕46号)及有关规定计算。
上述综合征地补偿费用中,在法定征地补偿标准基础上增加的费用为被征地农民社会保障费用政府出资部分。
第七条 由省以上相关部门组织实施的土地征收事项,其补偿标准由省政府及相关部门确定。
第八条 征地补偿费中的土地补偿费和安置补助费,按照国家有关规定划分。
土地补偿费支付给享有被征收土地所有权的农村集体经济组织。农村集体经济组织如不能调整质量和数量相当的土地给被征地农民继续承包经营的,必须将不低于70%的土地补偿费主要分配给被征地农民。土地补偿费中扣除直接支付给被征地农民的部分后,其余部分由被征地的农村集体经济组织专门用于被征地农民参加社会保险,发展二、三产业,解决被征地农民的生产和生活出路,兴办公益事业等。
安置补助费根据不同的安置途径确定支付对象。有条件的农村集体经济组织或用地单位统一安置被征地农民的,安置补助费支付给农村集体经济组织或安置单位。不进行统一安置的,安置补助费全额发放给被安置人,由其自谋职业,并按规定缴纳社会保障费用。村集体经济组织在发放安置补助费之前,必须对发放对象、方式、范围进行严格界定,综合考虑年龄、职业、户口等因素。
征地补偿费的分配与使用,由村集体经济组织通过村民代表大会表决通过,或采用村规民约等方式确定。
第九条 在市中心城区规划范围内征收集体经济组织的土地,除实行货币安置、社会保障安置等方式外,还可实行留地安置。留用土地必须符合土地利用总体规划和城市规划并征收为国有。留地安置具体办法另行制定。
第十条 市中心城区规划范围外,集体土地的征收、补偿和安置,可参照本规定执行。被征收集体土地上的房屋拆迁(搬迁)按照现行有关规定执行。
第十一条 本暂行规定有效期2年。国家政策调整后,按国家调整后的政策执行。

湖北省土地管理实施办法
第十七条 实行占用耕地补偿制度。非农业建设经批准占用耕地的，按照“占多少、垦多少”的原则，由占用耕地的单位负责开垦与所占用耕地的数量和质量相当的耕地;没有条件开垦或者开垦的耕地不符合要求的，应当按照下列标准缴纳耕地开垦费:
(一)占用基本农田的，按土地补偿费的,(,倍以上,倍以下缴纳; (二)占用基本农田以外的耕地，按土地补偿费的,倍以上,(,倍以下缴纳,耕地开垦费应当列入建设项目总投资,耕地开垦费收取、使用的具体管理办法由省人民政府另行制定。
第二十六条 征用土地按照下列标准支付土地补偿费，安置补助费和地上附着物、青苗等补偿费:
(一)征用耕地的，土地补偿费为该耕地被征用前三年平均年产值的,倍以上,,倍以下;征用其他土地的，土地补偿费为邻近耕地前三年平均年产值的,至,倍;被征用土地上的青苗，能计算产值的，按产值补偿，不能计算产值的给予合理补偿;被征用土地上的建筑物、构筑物等地上附着物的补偿标准参照市场价格予以合理补偿。在征用土地方案公告后抢种、抢建的不予补偿。 (二)征用耕地的，每一个需要安置的农业人口的安置补助费标准，为该耕地被征用前三年平均年产值的,至,倍，但每公顷被征用耕地的安置补助费，最高不超过该耕地被征用前三年平均年产值的,,倍。征用有收益的其他土地，安置补助费标准为邻近耕地前三年平均年产值的,倍至,倍。征用无收益的土地，不支付安置补助费。
(三)依照本条第(一)项、第(二)项规定支付土地补偿费和安置补助费，尚不能使需要安置的农民保持原有生活水平的，经省人民政府批准，可以增加安置补助费。但土地补偿费、安置补助费总和不得超过该土地被征用前三年平均年产值的,,倍。
(四)征用城市郊区的菜地，应当按照国家和省有关规定缴纳新菜地开发建设基金。新菜地开发建设基金的收取、使用、管理按蔬菜基地建设保护的有关法规、规章执行。
(五)使用国有农用土地的补偿标准参照上述规定执行。 (六)法律、法规另有规定的从其规定。

关于郧十高速公路建设征地及动迁补偿标准

郧县、茅箭区人民政府，市政府有关部门:
为支持郧十高速公路建设，改善我市交通环境，根据《中华人民共和国土地管理法》、《省人民政府关于公布湖北省征地统一年产值标准和片区综合地价的通知》(鄂政发〔2009〕46号)精神，现将郧十高速公路建设征地拆迁补偿标准及有关问题通知如下:
一、永久性征地、临时占用土地的补偿，严格按鄂政发〔2009〕46号文件的规定，根据不同片区、不同分类标准执行，临时用地根据实际使用年限按年产值补偿青苗费。
二、房屋拆迁按房屋建筑结构分类补偿，具体分类标准为:砖混结构每平方米360元，砖木结构每平方米260元、土木结构每平方米160元、简易房(含圈舍、厕所)每平方米50元、围墙每平方米20元、水泥地坪每平方米20元。
三、其他地上附着物补偿标准为:水井每口300元、机井每口2000元、沼气池每处1200元、蔬菜大棚每平方米6元，坟墓按不同类别据实补偿。
四、林木植被补偿标准为:挂果树每株60元、未挂果树每株5元、其他杂树直径大于10厘米的每株10元、直径小于10厘米大于3厘米的每株2元。苗圃每亩1200元，竹园每亩800元。
五、电力、电讯、广播电视、通讯光纤光缆的迁移，原则上只补偿材料费，由建设单位会同产权单位根据迁移数量和难易程度协商解决。
六、项目建设征占用土地所产生的剩余劳动力，由当地政府通过调整土地实行农业安置。
七、工程建设要注意节约用地，做好耕地占补平衡。各级政府及协调指挥部门，要协助建设单位取土造地，搞好土地复垦，确保沿线群众生产生活不受影响。

工作，沿线各级政府及有关部门要切实落实各项补偿政策，按省建设指挥部和地方协调指挥部的工作安排如期完成征地拆迁工作。各相关部门要从支持高速公路建设的大局出发，提高办事效率，为我市高速公路建设创造良好施工环境，确保高速公路建设顺利进行。

根据《国务院关于深化改革严格土地管理的决定》(国发〔2004〕28号)精神和我省实际，现将《湖北省征地统一年产值标准和区片综合地价》(以下通称新征地补偿标准)予以公布，自2009年12月1日起开始实施。
一、充分认识实施新征地补偿标准的重要意义
实施新征地补偿标准，是进一步加强征地补偿安置工作，解决当前征地工作中存在的补偿标准偏低、区域不平衡等突出问题，维护被征地农民合法权益的一项重大举措，对维护社会和谐稳定、保障经济社会平稳较快发展具有十分重要的意义。各地、各有关部门要充分认识实施新征地补偿标准的重要性，通过多种形式向社会广泛宣传制定和执行新征地补偿标准的原则、依据和有关内容，争取得到社会各界的理解和支持。
二、认真做好新征地补偿标准实施工作

附作物的补偿标准以及补偿标准的修正系数的基础数据，由省国土资源厅汇总后制定相关具体标准，报省人民政府批准后实施。
土地补偿费倍数和安置补助费倍数，应根据国家有关规定，并考虑当地经济发展和农民基本生活保障水平合理确定，原则上安置补助费倍数高于土地补偿费倍数。
青苗补偿标准一般为统一年产值的1倍，大棚蔬菜可适当提高标准。地上附着物补偿标准由各地结合实际情况合理确定。青苗和地上附着物的补偿范围应以征地调查确认结果为依据，依法告知后，凡被征地农村集体经济组织和农户在拟征土地上抢栽、抢种青苗和抢建的地上附着物，征地时一律不予补偿。
征收菜地、园地、林地、未利用地等其他土地，各地可根据实际情况确定征地补偿标准修正系数，菜地、果园、茶园、精养鱼池等(抢栽、抢种、抢挖的除外)一般要高于1 0，林地一般为0 7，未利用地一般为0 3。
国有农用地补偿参照此次公布的标准执行;涉及收回国有土地使用权的，应对国有土地使用权人予以合理经济补偿，具体办法由各地制定。
三、切实做好新旧征地补偿标准的衔接工作
新征地补偿标准公布后，各地要周密组织，统筹安排，防止因实施新征地补偿标准引发矛盾。实施征地过程中，要严格履行告知、确认、听证等程序，充分尊重被征地群众的知情权、参与权、监督权和申述权，做好批前告知和批后公告。要针对新征地补偿标准实施后可能发生的问题，制订工作预案，建立纠纷处理与协调机制，确保新老征地补偿标准顺利衔接、平稳过渡。
四、加强对实施新征地补偿标准的监督

省政府办公厅近日制定了我省被征地农民社会保障政策。根据该项政策，符合条件的被征地农民，按规定纳入低保;未参加养老保险或按灵活就业人员参保的，纳入养老保障范围。
享受这些政策必须同时具备以下条件:被征地时间在2006年4月10日后、被征地时年满16周岁、被征地时签订了《家庭土地承包合同》并持有《土地承包经营权证》、征地后家庭人均占有耕地在0.3亩以下、被征地时户口在征地所在地。
根据政策，相关部门对城市规划区内的被征地农民，应根据当地经济发展水平和被征地农民的不同年龄段，制定保持其生活水平不下降的办法;对符合享受低保条件的，按规定纳入低保范围。
这项政策还要求建立被征地农民养老保障制度，即:城市规划区内处于劳动年龄段的被征地农民，已在城镇企业就业或已转为城市户口自谋职业或灵活就业的，可参加城镇职工基本养老保险或按城镇灵活就业人员参保;城市规划区外的被征地农民、城市规划区内未参加城镇职工基本养老保险或按城镇灵活就业人员参保的被征地农民，纳入被征地农民养老保障制度。
养老保障所需资金由被征地农民、农村集体经济组织和当地政府共同承担，承担比例及缴费具体办法，由县(市、区)政府确定。被征地农民所需承担的个人缴费，可从所得的土地补偿费、安置补助费中直接缴纳。(王孝武)

宜昌最高4.9万元/亩，今年12月1日起实施
湖北省政府昨日公布征地统一年产值标准和区片综合地价 (以下简称新征地补偿标准)。其中，区片综合地价最高30万元/亩;征地统一年产值标准最高4.9万元/亩。该标准自2009年12月1日起开始实施。
据了解，新征地补偿标准由土地补偿费、安置补偿费两部分构成，不含青苗补偿费、地上附着物补偿费。省政府要求，新征地补偿标准公布后，各地要按照同地同价、协调平衡、公开透明的原则实施征地补偿。
据介绍，征地区片综合地价涉及武汉、襄樊、荆州、黄石四地。最高的为武汉市?区，30万元/亩，范围在江岸区后湖花桥、红桥等地，最低的在黄石?区，37180元/亩。
在征地统一年产值标准中，宜昌城区?区的征地补偿标准最高，为49497元/亩，区域为西陵区窑湾乡、峡口风景区、伍家
岗区伍家乡、宜昌经济技术开发区。最低的是长阳?区，1.62万元/亩。
此外，城区?区补偿标准为39387元/亩，区域为点军区点军街道办事处、联棚乡、猇亭区古老背乡、虎牙乡(除高家、高湖村以外)、云池乡(除福善场村以外);城区III区补偿标准为34561元/亩，区域为点军区桥边镇、艾家镇、土城乡、猇亭区虎牙高家、高湖村、云池乡福善场村。夷陵区?区补偿标准为4万元/亩，区域是小溪塔城市规划内各村(居)、场;夷陵区?区补偿标准为3.24万元/亩，区域为集镇规划区内各村(居)、场;夷陵区III区补偿标准为2.89万元/亩，区域为除?、?区域以外的各村(居)、场。
